Introduction

1. These terms and conditions govern your (also referred to as "Client") use of "Awaking Happiness" ("AH") by Desi Stefanova (also referred to as "Company"). By using AH, You, the Client, accept these terms and conditions in full. If You disagree with these terms and conditions or any part of these terms and conditions, You must not register for AH.

Description of AH

2. AH is a 6-month long personal development and self-improvement program that provides the Client with 12 PSYCH-K® Sessions which are in-person 90-minute sessions, online, a Workbook with exercises and daily journaling/self-discovery, a set of 12 purest quality essential oils (plus a diffuser and a wooden storage box), a Neurographica® Basic User Video Course and community support to help the Client achieve their goals and live the life they desire. It is a multifaceted Program that incorporates a variety of techniques and processes for working with the subconscious mind. 

Registration and Payments

3. In order to access AH, the Client must register by accepting these T&Cs, filling out the Enrollment Form and paying the relevant fee. For payment in installments, the second payment must be made after completion of the sixth PSYCH-K® Session. If the second instalment payment is not received in time, AH cannot continue. The Company reserves the right to change the fees for the Program at any time. The Client is responsible for providing accurate and complete registration information and for updating that information as necessary.

Upon receiving of payment, both parties must agree on mutually acceptable time for the online sessions. The Company operates in GMT (London) zone. 

Upon confirmation of Client's shipping address, the Company will arrange the shipment of the 12 essential oils kit (with diffuser and storage box). 

The Client will have access to the Workbook pdf to print at home or use from an electronic device.

Client Responsibility

4. AH IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. IT IS NOT INTENDED AS A SUBSTITUTE FOR PROFESSIONAL ADVICE AND SHOULD NOT BE RELIED UPON AS SUCH. THE INFORMATION PROVIDED IN THIS PROGRAM IS NOT INTENDED TO DIAGNOSE OR TREAT ANY MEDICAL OR MENTAL HEALTH CONDITION. 

BY PARTICIPATING IN AH, THE CLIENT AGREES TO TAKE FULL RESPONSIBILITY FOR THEIR OWN WELL-BEING, INCLUDING SEEKING PROFESSIONAL ADVICE IF NECESSARY, AND FOR ANY ACTIONS OR DECISIONS THEY MAKE AS A RESULT OF THE INFORMATION PROVIDED IN AH. THE COMPANY WILL NOT BE HELD LIABLE FOR ANY DAMAGES RESULTING FROM THE CLIENT'S PARTICIPATION IN AH. DESI STEFANOVA IS NOT A LICENCED PSYCHOLOGIST OR SPECIALIST HEALTHCARE PROFESSIONAL. DESI'S SERVICES DO NOT REPLACE THE CARE OF A PSYCHOLOGIST OR OTHER HEALTHCARE PROFESSIONALS. 

PLEASE BE AWARE THAT AH IS NOT A QUICK FIX SOLUTION, BUT A PROCESS OF SELF-DISCOVERY AND GROWTH THAT REQUIRES CONSISTENT EFFORT AND DEDICATION IN ORDER TO SEE THE RESULTS DESIRED. THE COMPANY MAKES NO REPRESENTATION OR GUARANTEE THAT AH WILL PRODUCE ANY SPECIFIC RESULT OR OUTCOME, AND THE CLIENT ASSUMES ALL RISKS ASSOCIATED WITH PARTICIPATION IN AH. 

Refund Policy

5. Due to the nature of AH, The Company does not offer refunds once it has started. By registering for AH, You (The Client) acknowledge and agree that You will not be entitled to a refund. 

Intellectual Property

6. The content of AH, including but not limited to, the text, graphics, images, logos, and all other materials, is protected by copyright and other intellectual property rights. The Client may not reproduce, repurpose or resell any of the content of AH without the Desi Stefanova's express written permission.

Limitations of Liability

7. The Company makes no representations or warranties of any kind, express or implied, as to the operation of AH or the information, content, materials, or products included in AH. The Company will not be liable for any damages of any kind arising from the use of AH, including but not limited to, direct, indirect, incidental, punitive, and consequential damages.

Indemnification

8. You (the Client) agree to indemnify and hold Desi Stefanova (the Company) and our affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of Your use of AH, Your violation of these terms and conditions, or Your violation of any rights of another.

Confidentiality

9. The Company is committed to maintaining the confidentiality of the Client information and any other sensitive information shared during the PSYCH-K® Sessions. The Company will not disclose any confidential information without the client's prior written consent, except as required by law. We are committed to adhering to the ethical standards and codes of conduct of the coaching profession.

Termination

10. Either party may terminate this agreement upon written notice if the other party breaches any of the terms and conditions of this agreement.

Independent Contractor Status

11. The Company (Desi Stefanova) shall be an independent contractor and nothing in this agreement shall be deemed to create an employer-employee relationship, partnership, or joint venture between the parties.

Dispute Resolution 

12. In the event of any dispute arising out of or in connection with this agreement, the parties will first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved within 30 days, either party may initiate mediation or any other form of alternative dispute resolution mutually agreed upon by the parties.

Force Majeure 

13. In the event that either party is prevented from performing, or is unable to perform, any of its obligations under this agreement due to any cause beyond the reasonable control of the party invoking this provision, the affected party's performance shall be excused and the time for performance shall be extended for the period of delay or inability to perform due to such occurrence.

Governing Law

14. These terms and conditions shall be governed by and construed in accordance with the UK law. Any dispute arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the UK courts.

Modifications

15. The Company reserves the right to make changes to these terms and conditions from time to time. The Client's continued use of AH following any changes indicates the Client's acceptance of the new terms.
